Instagram backtracks on new interpretation of photo ownership

KWIKA partner Jeremiah Reynolds was quoted in Ted Johnson’s article in Variety on photo-sharing service Instagram’s recent announcement that its users would not be compensated for the commercial exploitation of their posted photos.

The original announcement, made on December 17, generated such an outcry that Instagram withdrew the policy from its user terms of agreement the very next day.  As noted in the article, the copyright to a photo is owned by the person who took it, and Instagram was effectively claiming that users of its service were agreeing to give that up.
