Judge Orders 'Hurt Locker' Plaintiff to Pay Attorney Fees
Sgt. Jeffrey Sarver, whose unsuccessful lawsuit against KWIKA clients Mark Boal and Kathryn Bigelow claimed their film The Hurt Locker was based on Sarver's personal military experiences, has been ordered to pay the attorney fees of all parties involved.  Dale Kinsella and Jeremiah Reynolds represented screenwriter Boal and director Bigelow in the suit, which was dismissed by U.S. District Judge Jacqueline Nguyen two months ago. read more

Larry Iser and Greg Gabriel Defeat Anti-SLAPP Motion and Slap Back
When an LA music lawyer was terminated by a Band due to false and defamatory statements by the Band’s auditor that the lawyer had not properly negotiated the Band’s record contract, KWIKA filed suit for the music lawyer. The auditor moved to dismiss the suit under California’s anti-SLAPP statute on the basis that his statements were protected free speech. Larry and Greg not only prevailed on the motion to dismiss read more

Michael Kump and Jonathan Steinsapir Win One for Shaq
When NBA legend Shaquille O’Neal was sued by an alleged former business associate who claimed the basketball great had ordered him to be kidnapped, he turned for help to KWIKA partners Michael Kump and Jonathan Steinsapir who removed the action to federal court and filed a motion to dismiss the entire lawsuit. The motion—which made it clear Shaq denies plaintiff’s ludicrous allegations—argued the entire action was time-barred by the applicable statute of limitations. read more

KWIKA Obtains Jury Verdict for Mattel, Inc. in Licensing Dispute Over Board Game
EL SEGUNDO, California (June 22, 2011) – A Los Angeles Superior Court jury has found in favor of toy manufacturer Mattel, Inc., ruling that Mattel fully complied with the terms of a 2004 license agreement for the distribution of the board game "Outburst."  A KWIKA team that included Larry Iser, Kristen Spanier, Patricia Millett and Chad Fitzgerald represented Mattel.  Following a nearly month-long trial, on June 20, 2011, the jury returned a verdict rejecting the claim of plaintiff Hersch & Co. that Mattel had failed to advertise the board game as required by the license agreement. The jury verdict comes on the heels of an earlier ruling by Judge Kevin C. Brazile granting Mattel's motion for nonsuit, dismissing all of Hersch's other claims, leaving only the advertising claim for the jury. Mattel distributed "Outburst" from 2004 through 2008. read more

Michael Kump and Jeremiah Reynolds Score Big Victory for Kardashians
KWIKA partners Michael Kump and Jeremiah Reynolds, representing the Kardashian sisters (Kim, Khloe and Kourtney), filed an anti-SLAPP motion to have a complaint thrown out because a debit card company was seeking to hold the Kardashians liable for exercising their right of free speech on a matter of public interest.  Fresno County Superior Court Judge Jeffrey Hamilton agreed, and granted the motion filed by Kump and Reynolds and awarded attorneys' fees to defendants. read more
